Published October 15, 2026. From Friday, October 16, asset managers in Thailand can start building Bitcoin and Ether exchange-traded funds for the Stock Exchange of Thailand. The country's Securities and Exchange Commission has issued 11 notifications that set the rules: passive funds only, local custody, no margin loans and a risk check for every buyer. No fund has been approved or listed yet, so the framework is in force before the first product exists.

Key takeaways

  • The Thai SEC issued 11 notifications on crypto ETFs, announced on October 8, 2026 (SEC news release No. 216/2026). They take effect on October 16, 2026.
  • Eligible assets: Bitcoin and Ether only at first. The SEC can add others later based on liquidity, market acceptance, network security and investor protection.
  • Structure: passive funds tracking the price of one crypto asset, with average net exposure of at least 80% of NAV to that asset over each accounting year.
  • Safeguards: custody only with SEC-regulated digital asset custodians, listing only on the SET, no margin loans, and a mandatory risk acknowledgment before trading.
  • Home bias by design: Thai mutual and private funds may now buy local crypto ETFs, but in the initial phase brokers cannot offer foreign crypto ETFs to retail clients, and depositary receipts on foreign crypto ETFs are not allowed.

Why it matters

A regulated on-ramp in a big retail market. Thai investors can already buy crypto through licensed local exchanges. An ETF on the SET brings crypto into ordinary brokerage accounts and, more importantly, lets Thai mutual and private funds hold it locally, which they could only do through foreign ETFs until now.

Capturing demand at home. By blocking retail access to foreign crypto ETFs in the initial phase, the SEC is steering demand toward Thai products and Thai custodians. It is the opposite of the US model, where funds compete freely: the 12 US spot Bitcoin ETFs tracked by Farside have gathered 57.0 billion dollars of net inflows since January 2024 (ETF flows tracker).

Conservative guardrails. No leverage, passive only, local custody and a risk check before the first trade: Thailand is opening the door, but carefully, at a time when US spot ETFs are seeing volatile flows (−261.4 million dollars on October 14 alone) and inflation data is pushing the Fed toward higher rates (see our September PPI analysis).

What to watch next

  • The first fund filings by Thai asset management companies and the custodians they choose.
  • The SET listing date of the first Bitcoin ETF, and whether an Ether ETF launches at the same time.
  • Any addition to the list of eligible crypto assets, and whether the SEC later allows foreign custodians or foreign crypto ETFs for retail investors.
